Personal Injury Lawyer · Casper, WY

Casper · Natrona County

Casper sits where I-25 meets Highways 20/26. That makes it the crossroads for central Wyoming’s freight and oilfield traffic, and for a particular kind of crash: heavy vehicle, high energy, serious injury.

Deep Waters Law represents injured people in Casper and across Natrona County. Wyoming gives you four years for most injury claims and two for wrongful death, you can recover as long as your share of fault is not more than 50%, and there is no cap on damages against a private defendant.

Where Casper injury cases are heard

Larger civil claims go to Natrona County District Court (Seventh Judicial District); smaller ones to Natrona County Circuit Court. Casper also has a federal courthouse for the District of Wyoming, which matters when a case involves parties from different states, as is common when the defendant is an out-of-state trucking company or a national insurer.

What we handle here

  • Car and truck collisions, including commercial vehicle cases governed by federal motor carrier rules, where logging data and maintenance records must be preserved immediately.
  • Oilfield and industrial injuries (see below).
  • Premises liability, keeping in mind Wyoming’s natural accumulation rule for snow and ice.
  • Wrongful death, with a two-year deadline that Wyoming courts enforce strictly.
  • Claims against institutions that allowed harm to happen, such as hospitals, schools, and employers.

Hurt on the job?

Workers’ compensation is usually the only claim against your own employer. But when someone other than your employer caused the injury, such as another company’s truck, a contractor on the same site, or a defective piece of equipment, you may have a separate claim that workers’ compensation does not limit. On a crowded oilfield or industrial site, sorting out which company is responsible for what is often where the real recovery is found.

Three Wyoming rules that decide Casper cases

Comparative fault. You recover unless your share of fault is more than 50%. At 50% you recover half; at 51%, nothing.

No joint and several liability. Each defendant pays only its own share. If one responsible party is uninsured, the others do not cover that share, so every responsible party has to be identified early.

Underinsured motorist coverage is not required. Broderick v. Dairyland Insurance Co. (2012) confirmed insurers need not provide it and drivers need not carry it. With minimum liability limits of $25,000 per person, your own declarations page is often the most important document in a serious Casper crash.

If a government vehicle or public property is involved

City, county, and state claims run under the Wyoming Governmental Claims Act: a written, itemized claim within two years that you personally sign under penalty of perjury, then suit within one year of filing it. Recovery is capped at $250,000 per claimant. Road design and maintenance, including weather maintenance, are immune; negligent driving of a government vehicle is not.

Injury cases are handled on a contingency fee: no attorney’s fee unless we recover for you. How case costs are handled is explained in writing before you sign anything.
