About Us
When you are with Deep Waters Law, the law is not settled until it is just.
Deep Waters Law was not built to back down from institutional power—or back down from the bench. Founded by Wyoming attorney Francis H. McVay, the practice exists for one singular purpose: to hold powerful systems accountable and protect human lives when the weight of the system threatens to crush them. McVay does not yield when the pressure rises, whether that means standing his ground for hours against a court or holding the state strictly to its mistakes until a case is dismissed.
The justice system is a noble institution worthy of profound respect, but left uncalled on its brutality, the status quo crushes the innocent and the unloved. Whether it is a family seeking accountability from a hospital or school that allowed harm to come to a true victim, an individual facing the full force of a state with its endless reserves of money to prosecute, or a father fighting for custody rights and parent-child equity in the emotionally trying dissolution of a family—the crushing tidal wave of any legal crisis is inevitable once started. When the tidal wave rises to hit and the chaos takes hold, McVay asks one question: How long will you swim alone?
Unmasking Institutional Power
In his legendary dissent, Justice Antonin Scalia warned that while systemic overreach often arrives “clad, so to speak, in sheep’s clothing… this wolf comes as a wolf.” McVay does not step into those arenas as a lamb—because to catch a wolf, it takes a wolf. Whether sitting across a corporate mediation table, taking on a hospital risk-management board, or facing a prosecutor’s desk, McVay sees the system for what it is and refuses to let power play games with human lives.
With over a decade of trial experience as a former prosecutor, defense trial attorney, and multiple-time appellate advocate before the Wyoming Supreme Court, McVay knows the legal system from every angle. He leverages this 360-degree courtroom insight across criminal defense, fathers’ rights and family law, personal injury, school and medical accountability, business formation, and tribal law. McVay understands how institutions operate, where their armor is weak, and how to dismantle their defenses. Navigating the brutality of the Title 25 and criminal defense systems, McVay has shut prosecutions down early—securing seven pre-trial exonerations via the insanity defense (previously known as NGMI) and juvenile mens rea challenges before the state could drag those families and accused individuals into court. When an opposing party or a negligent institution begins to fracture under the weight of truth, McVay does not hesitate. That which is falling, McVay will push.
Standing Beside You in the Deep Waters
Society and its institutions are quick to label, discard, and “other” those they find inconvenient. Deep Waters Law exists to defy that status quo—to stand for the voiceless, confront institutional power, and relentlessly fight injustice wherever it takes root.
Grounded in the promise of Isaiah 43:2—“When you pass through deep waters, I will be with you”—McVay guides his clients through the deepest, most transformative trials of their lives so they can survive the tidal wave’s crush, reclaim their dignity, and discover their strength on the other side. Justice takes many trails, but the client holds the map. From initial crisis to the finality of the Supreme Court, McVay executes that vision with unyielding advocacy, direct answers, and total loyalty. That commitment was proven on the record by overturning the state’s unjust jury verdict under the legal system’s harshest appellate hurdle—plain error—in Walker v. State, 521 P.3d 967 (Wyo. 2022).
