Gillette · Campbell County
In an energy town, a charge is never just a court problem. A DUI or a felony in Campbell County can become a job problem, a CDL problem, and a problem for everyone who depends on your paycheck.
Deep Waters Law defends criminal and DUI charges in Gillette and across Campbell County, from the first appearance through trial.
Where Gillette cases are heard
Misdemeanors, initial appearances, and preliminary hearings go to Campbell County Circuit Court. Felonies are bound over to Campbell County District Court, in the Sixth Judicial District. City citations go to Gillette Municipal Court, a different court where people often plead guilty at the counter without knowing what the conviction will follow them into.
What we handle here
- DUI. A Wyoming DUI is two cases, and you generally have 20 days from the notice of suspension to request a license hearing.
- Drug possession, including first-offense deferral under Wyo. Stat. § 35-7-1037.
- Domestic battery and assault, with their no-contact conditions and federal firearms consequences.
- Theft and fraud, which background checks flag as crimes of dishonesty.
- Probation violations. A revocation is a hearing, not a formality.
- Juvenile matters, where the rules and the stakes are different.
Your job is part of the case
Many Campbell County employers hold safety-sensitive positions, test for drugs, and run background checks. A deferral or a reduction that avoids a conviction can save a career that a quick guilty plea would end. That decision is made early, usually before the first court date.
If you hold a CDL, tell us on the first call. A DUI can disqualify a commercial license even when the offense happened in your own vehicle.
Diversion and keeping the record clean
For a first offense, the conviction usually matters more than the sentence. Diversion, deferred prosecution, and deferred sentencing can end a case without a conviction, but they are widest before a plea is entered and narrow quickly after.
Both chairs
Francis H. McVay has sat on both sides of the courtroom. As a Deputy County and Prosecuting Attorney in Park County, he charged misdemeanors and felonies and handled juvenile and Title 25 matters. As Senior Assistant Appellate Counsel with the Wyoming State Public Defender, he briefed and argued Walker v. State, 2022 WY 158, in which the Wyoming Supreme Court reversed two convictions under plain-error review and ordered a new trial on them. He is a graduate of the Gerry Spence Trial Lawyers College. He knows how the State builds a case, and he knows how the record reads when a higher court looks at it.

Frequently asked questions
Can a Cheyenne firm handle my Gillette case?
Yes. Wyoming has one state court system, and Deep Waters Law serves Gillette and Campbell County.
Will a charge cost me my job?
It depends on the charge, your employer’s policy, and above all whether the case ends in a conviction. That is why the first few weeks matter.
Should I talk to the officer or my probation agent about what happened?
Not before talking to a lawyer. What you say becomes evidence.
